Terms of Service & Privacy Policy

PART I: TERMS OF SERVICE

1. Introduction & Acceptance of Terms

Welcome to our services. By accessing, browsing, or utilizing our platform and engaging our services, you formally agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to all terms and conditions, you must immediately cease use of our services.

2. Scope of Services

We provide document preparation, credit education, and organizational services designed to assist you in understanding your credit profile and challenging inaccurate, unverifiable, or obsolete information with the credit bureaus. We act on your behalf based strictly on the information you provide.

3. User Responsibilities & Cooperation

Your active participation is mandatory. You agree to provide accurate and truthful information, maintain active credit monitoring as requested, and promptly forward all correspondence received from credit bureaus or creditors to our team. Failure to cooperate may pause or hinder the execution of our services.

4. Fees & Billing in Arrears

In strict compliance with applicable federal and state laws, including the Credit Repair Organizations Act (CROA), you will not be charged any fees until after the contracted services for that specific billing cycle have been fully and completely performed. Fee amounts and schedules are detailed in your specific Client Agreement.

5. Right to Cancel

You may cancel your contract with us, without any penalty or obligation, at any time before midnight of the third business day after the date on which you signed the agreement. This right is guaranteed under federal law, and nothing in these Terms shall be construed as a waiver of this fundamental protection.

6. No Guarantee of Results

We cannot and do not guarantee a specific score increase, a specific outcome, or that any specific items will be successfully removed from your credit profile. The final determination of what remains on your credit report rests solely with the credit bureaus and your original creditors.

7. Privacy & Data Security

The protection of your sensitive personal information is our priority. We employ industry-standard encryption and security measures. We will never sell your personal data to third parties. Our full data practices are detailed in our Privacy Policy, which is incorporated by reference into these Terms.

8. Intellectual Property

All website content, software, educational materials, logos, and proprietary methods provided by us remain our exclusive intellectual property. You are granted a limited, non-exclusive license to use these materials solely for your personal credit education and not for commercial distribution or reproduction.

9. Term & Termination

This agreement takes effect upon your acceptance and continues month-to-month until properly terminated. You may cancel our services at any time by providing written notice as outlined in your Client Agreement. Upon cancellation, you will only be responsible for fees covering services that have already been fully executed.

10. Disclaimers & Legal Status

We are not a law firm and we do not provide legal advice, tax advice, or financial planning services. Our services are provided on an 'as-is' and 'as-available' basis. Any information or education provided by us is strictly for general informational purposes and should not be construed as legal counsel.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability for any claims arising out of or relating to our services is strictly limited to the actual amount of fees you paid to us for the specific services rendered during the six (6) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold us—along with our officers, directors, and employees—harmless from any claims, damages, liabilities, and expenses arising out of your breach of these Terms or your violation of any laws, regulations, or third-party rights while using our platform.

13. Communication Preferences

By establishing an account, you consent to receive service-related communications from us via email, phone, or SMS text messaging at the contact numbers provided. You may opt out of promotional messages at any time, but transactional or service-critical updates will continue while your account is active.

14. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated to you directly via email or a prominent notification on our platform prior to taking effect. Your continued use of our services following any changes constitutes acceptance of the new Terms.

15. Governing Law & Court Jurisdiction (No Arbitration)

These Terms shall be governed strictly by the laws of the state in which you reside. Any and all disputes arising from these Terms or our services shall be resolved exclusively in a court of competent jurisdiction. We explicitly waive any right to compel mandatory arbitration. Nothing in this agreement restricts your right to seek legal remedies in court.

16. Severability

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of any of the remaining provisions.

17. Entire Agreement

These Terms of Service, together with your specific written Client Agreement and our Privacy Policy, constitute the entire, exclusive agreement between you and us regarding our services. They supersede any prior agreements, representations, or oral understandings between the parties.

Part II: PRIVACY POLICY

This Privacy Policy governs the manner in which MKK Enterprise LLC, a Minnesota limited liability company, doing business as MKK Financial, collects, uses, maintains, and discloses information collected from users. MKK Financial does not sell personal data to third parties.

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, subscribe to the newsletter, and in connection with other activities, services, features, or resources we make available.
